These Terms of Use ("Terms") govern your access to and use of HardFlooring.com.au, including the Floor Finder, Quote Checker, and any related content, reports or services (collectively, the "Service"), provided by HardFlooring.com.au ("HardFlooring", "we", "us", "our").

By accessing or using the Service — including by ticking the consent checkbox before submitting the Floor Finder or Quote Checker — you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. What HardFlooring Is — and Isn't

HardFlooring.com.au is an independent information service that provides general flooring guidance based on information you provide and publicly available climate, product and pricing data.

2. AI-Generated Content — General Information Only

The Floor Finder recommendations and Quote Checker assessments (including any "verdict", price comparison, or red flag identified) are generated using artificial intelligence (including the Anthropic Claude API) based on the information and documents you provide, combined with general market data we have compiled.

You acknowledge and agree that:

• AI-generated content may be incomplete, inaccurate, outdated, or simply wrong
• The Service does not verify the accuracy of any quote you upload, the qualifications or licensing of any retailer, or the suitability of any product for your specific property
• Market price comparisons are based on general industry bands at the time of writing and may not reflect current pricing, your specific location, supply availability, or the full scope of work required for your project
• A "fair", "good value", "overpriced" or similar verdict is a general indicative guide only and must not be relied upon as the sole basis for any financial decision
• Output is provided "as is" and "as available" without warranties of any kind, whether express or implied

3. Not Professional Advice

Nothing on HardFlooring.com.au constitutes professional advice of any kind, including but not limited to financial, legal, building, structural, engineering, or trade advice. You should obtain your own independent professional advice — including a qualified, licensed flooring installer's in-person assessment — before making any decisions about flooring products, suppliers, contracts, or expenditure.

Any specifications, climate data, product recommendations, pricing guidance, or "what to ask your installer" content is provided as a starting point for your own research and discussions with retailers and tradespeople — not as a substitute for their professional assessment of your property.

4. Your Responsibilities

By using the Service, you agree that:

• You will provide accurate information to the best of your knowledge
• Any document you upload (such as a flooring quote) is one you are entitled to share with us, and may contain another business's pricing and proprietary information
• You are at least 18 years of age, or using the Service with the consent of a parent or guardian
• You will not use the Service for any unlawful purpose, to submit false information, or to upload content that infringes the rights of any third party
• You are responsible for any decisions you make — including financial commitments — based on information obtained from the Service

5. Connection With Retailers

If you request a comparison quote through the Quote Checker, or are matched with a retailer through the Floor Finder, we will share your contact details, your inputs, and (where applicable) your uploaded quote document with the relevant "HardFlooring Verified" retailer(s) for your area.

HardFlooring Verified status reflects that a retailer has registered with our platform and provided certain information about their business. It is not a guarantee, endorsement, certification or warranty of the retailer's workmanship, pricing, licensing, insurance, financial stability, or conduct. Any contract for goods or services is between you and the retailer directly — HardFlooring is not a party to that contract and accepts no responsibility for its performance.

We are not responsible for any communications, quotes, products, services, disputes or outcomes arising from your dealings with any retailer, whether or not introduced via HardFlooring.

6. No Liability

To the maximum extent permitted by law, HardFlooring (including its owners, operators, and any related entities) excludes all liability for any loss or damage — direct, indirect, incidental, special, consequential, or otherwise — arising from or connected to:

• Your use of, or inability to use, the Service
• Reliance on any AI-generated recommendation, assessment, verdict, or price comparison
• Any decision to proceed with, decline, negotiate, or dispute a flooring quote based on information from the Service
• Any product purchased, work performed, or contract entered into with any retailer, whether or not introduced via the Service
• Errors, omissions, interruptions, defects, delays, or security breaches in connection with the Service

Where liability cannot be excluded under the Australian Consumer Law (ACL) or other applicable law (including statutory guarantees that apply to the supply of goods and services to consumers), our liability is limited, to the extent permitted by law, to the resupply of the relevant part of the Service.

7. Intellectual Property

All content on HardFlooring.com.au — including text, design, branding, tools, and underlying logic — is owned by or licensed to HardFlooring and protected by copyright and other intellectual property laws. You may use generated reports for your own personal, non-commercial purpose of obtaining flooring quotes. You may not reproduce, redistribute, or commercially exploit our content or tools without our written permission.

8. Third-Party Quote Documents

Documents uploaded to the Quote Checker may contain the intellectual property and confidential pricing of third-party retailers. We process these solely to generate your assessment and, where you request it, to facilitate a comparison. We do not publish, resell, or use uploaded quote documents for any purpose other than as described in our Privacy Policy.

9. Availability and Changes

We may modify, suspend, or discontinue the Service (or any part of it) at any time without notice. We may also update these Terms from time to time; continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
